In order for this online community to prosper, it is essential that all users respect copyright.  Supporting copyright is of extreme importance to PimpArtworks and is also a non-negotiable policy.  You must only upload content which you have created yourself, have permission to use and which you have the authority to allow PimpArtworks to use.  Browsers or customers must also respect the copyright of all content viewed or purchased on PimpArtworks website and must not use or distribute it without the authorisation of the content owner.

You need to be fully aware that displaying and publishing your work on PimpArtworks attracts legal responsibilities.  It is down to you to make sure you are not breaking any laws in doing so.

Welcome to the PimpArtworks (“PimpArtworks”) Terms of use.  PimpArtworks provides its website and related services (“Site”) subject to the following Terms of Use (“Terms”).  Please read these Terms and indicate your acceptance during the registration process.  PimpArtworks reserve the right to modify these Terms from time to time and such modification shall be effective upon posting to the Site.  By continuing to use the Site you are indicating your agreement to be bound by these Terms and all revisions thereof.

PimpArtworks will only knowingly provide use to parties that can lawfully enter into and form contracts under applicable law.  Therefore, minors under the age of 18 may not use or access PimpArtworks without the direct supervision and/or participation of their legal parent or guardian.

A user can become a registered member (“User”) of the Site by setting a password protected account.  Upon creating a user account, you agree to provide PimpArtworks with a current email address and to update such information immediately upon any changes.  You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account.  You must become a member before uploading any content onto the Site and this includes writing comments.  PimpArtworks reserves the right to cancel any User Account at any time, with or without reason.

You will retain ownership of the content you upload to PimpArtworks.   You grant PimpArtworks a royalty free, worldwide, non-exclusive license to use such content as PimpArtworks deems necessary to enable you to use the PimpArtworks service to create, produce, crop, publically display, sell and distribute for so long as your Content remains uploaded to the Site.  Our right to reproduce your images for sale to the public is completely dependant on your participation on the Site.

You represent and warrant that the content you upload to PimpArtworks that:

(i).  You own all copyrights to the content posted by you on the Site or otherwise have the right to grant the license set forth in this section.
(ii).  Your content does not violate the privacy rights, publicity rights, copyrights rights, or other intellectual property right of any other person.  You agree to pay for all royalties and fees owing any person by reason of any content you post on the Site.
(iii).  You pledge to never post or communicate content that may be deemed offensive, obscene, inaccurate, illegal, or incites violence.

PimpArtworks claims immunity from liability of any kind resulting from content posted, created, or communicated by Users.  You understand that PimpArtworks
reserves the right to review and if necessary remove any content posted, created, or communicated by you at any time, with or without reason.

Any violation of these Terms may result in the termination of your membership at the sole discretion of PimpArtworks.

You appoint PimpArtworks as your agent to market to and obtain orders from customers for the purchase of your products through the Site and to fulfil those orders through the manufacture and delivery of your products.  Earnings for the products on PimpArtworks are described on the Site and are incorporated into this Agreement by reference.  All prices are in GBP British Pounds.  Prices and products can be changed from time to time at the discretion of PimpArtworks.

(i).  The retail price charged to customers who purchase your products is made up of the PimpArtworks Base price plus your creator margin (“Commission”).  PimpArtworks will also charge the customer an additional postage and packaging fee which varies dependant on the customer’s location.  You are able to select any percentage markup over PimpArtworks Base price, greater than or equal to 0%, to determine your Commission.  You reserve the right to change your percentage Commission at any time by modifying it in your User Account section on the Site.  Any change will only apply to future sales and will not change the retail price or Commissions on orders already submitted.

(ii).  PimpArtworks will send you an email to the email address held in your User Account after a customer has placed an order for your products.

(iii).  Users are entirely responsible and will account for any taxes imposed by governments or governing authorities on payments earned via their Commission.

(iv).  Payment Terms.  PimpArtworks will pay your Commission on a monthly basis.  Within 15 days following the end of each calendar month, PimpArtworks will either forward a cheque or instigate a PayPal deposit for Commissions you have earned for the relevant month.  However, if the Commissions payable to you for the month are less than £50.00, PimpArtworks will hold your Commissions until the total amount due is at least £50.00 or until this Agreement is terminated.

v).  Termination Fees.  If you or PimpArtworks terminate your User Account and your Commissions owed total less than £50.00, PimpArtworks may charge you a £5.00 administration fee deducted from your Commission before realising the final payment.

vi).  PimpArtworks is not held accountable for any loss suffered by you due to incorrect details being held on your User Account with regards to your payment instructions.

PimpArtworks respects your privacy.  We will never distribute, rent or sell to third parties, any personal information that we collect about our members, customers or website visitors.  We are committed to protecting online user privacy.

Orders on PimpArtworks are processed using industry standard 256-bit encryption to ensure a completely secure connection when a payment is made.  Credit card information is processed and stored by our payment service provider, Paypal, which means we do not see or store this information.

Any data we store about any User is used in accordance to the UK Data Protection Act (1998).  PimpArtworks also have appropriate security measures in place in our physical facilities to protect against the loss, misuse or alteration of information we have collected from users of the website.

Shipping will be made by postal or courier service and will be paid for by the customer at the price indicated at the time of purchase. PimpArtworks reserve the right to ship partial orders at no additional cost to the customer.  It is the customer’s obligation to enter the correct delivery address details at time of ordering. If the customer enters the wrong address, PimpArtworks are not obliged to re-send the order to the correct address at our expense.

We provide you with an estimated date for delivery of all products and while we make every effort to deliver by this time, all dates specified are estimates only due to being dependant on the destination country’s custom office procedures.  PimpArtworks create each and every product to order and aim to dispatch within 2 to 3 business working days or an order being placed.

By using the PimpArtworks Site, you agree that you will not interfere with or disrupt or attempt to interfere with or disrupt the PimpArtworks Site, its servers or networks connected to PimpArtworks, or to disobey any requirements, procedures or policies of the Site.

You agree not to provide any information to PimpArtworks that is false or misleading, that attempts to hide your identity or that you do not have the right to disclose.  PimpArtworks does not endorse any content placed on the Site by third parties or any opinions or advice contained in such content.  You agree to defend, indemnify, and hold harmless PimpArtworks, its officers, directors, employees and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and expert fees, arising out of or in anyway connected with your access or use of the Site, or your violation of these Terms.

You acknowledge that PimpArtworks may review your content for adherence to our Terms in this Agreement and PimpArtworks have the right to remove any content that violates the Terms or is otherwise considered objectionable to PimpArtworks, with or without reason.  You must not abuse, harass, threaten, impersonate or intimidate other PimpArtworks users.  You must not create or submit unwanted email or messages to any PimpArtworks User.

You are solely responsible for your interactions with other PimpArtworks Users.  You must not abuse, harass, threaten, impersonate or intimidate other PimpArtworks users.  You must not create or submit unwanted email or messages to any PimpArtworks Users.  PimpArtworks reserves the right, but has no obligation, to monitor disputes between you and other Users.

Should you object to any terms or conditions or become dissatisfied with the Site in anyway, your only course of action is to immediately discontinue your use of the Site and/or terminate your account.  If you delete your User Account, which you may do for any reason and without penalty, we no longer have rights, outlaid in section 4, to reproduce and sell your uploaded content on your behalf.

You also acknowledge that PimpArtworks reserves the right to terminate your account or your access to and use of the PimpArtworks Site at any time at the sole discretion of PimpArtworks for any reason, with or without cause.  If you violate these Terms, PimpArtworks, at its sole discretion may also require you to remedy any violation of the Terms and/or take any other actions PimpArtworks deem appropriate to enforce its rights and pursue all available remedies.  We shall not be liable to you or any other person if we terminate your account or your access to or use of the Site.

We want you to be completely satisfied with your purchase so 100% of our products are quality checked throughout manufacturing and before leaving our production facility.  If your product does arrive with any damage or defects we do require photographic evidence before despatching a replacement product.  The Products on this website are bespoke i.e. made to order.  You cannot therefore return the product for a refund if it has been supplied accurately and as described on the website.  Returns will only be considered for goods that do not accurately reflect their description on this website. In order to exercise your option to return a Product, you must give a notice to us within 7 days of receipt of the Product.  Accepted notices are emails to info@pimpartworks.com. You must include the customers name and invoice number. Do not ship the products back to us, wait until we will send you Return Authorisation. We will consider your refund upon receipt of the returned Product.  Products that are returned because they do not accurately reflect the description of the product on this website must be unused, in their original condition and undamaged.  In this event a replacement product of the correct specification will take preference over a refund.

Due to differences in equipment, media, inks, and other conditions between colour proofing and the PimpArtworks production facility operations, a reasonable variation in colour between submitted images and the completed product is possible and is deemed acceptable performance.

The PimpArtworks website is using cookies and tracking technology.  A cookie is a small file which asks permission to be placed on your computer's hard drive. Once you agree, the file is added and the cookie helps analyse web traffic or lets you know when you visit a particular site. We use traffic log cookies to identify which pages are being used. This helps us analyse data about web page traffic and improve our website in order to tailor it to customer needs. We only use this information for statistical analysis purposes and then the data is removed from the system. You can choose to accept or decline cookies.  Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer, however this may prevent you from taking full advantage of the website.

The PimpArtworks website may contain links to enable you to visit other websites of interest easily. However, once you have used these links to leave our site, you should note that we do not have any control over that other website. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this privacy statement.
